Terms of Service
By commissioning, you automatically agree to the Terms of Services. Please, read them carefully before placing an order.✨ GENERAL
✦ In the following ToS are participating 3 sides: artist, client, and VGen;
✦ Client is requited to provide with clear references and clear ideas (moodboard, character reference, pose reference) in the commission request on the VGen page;
✦ Artist may use the artwork for promotional goals of artist's socials (including paid ones like Patreon), and commission services unless it was negotiated beforehand;
✦ All the message exchange between client and artist are confidential;
✦ Artist have the right to refuse the commission without explanation.💰 PAYMENTS & REFUNDS
✦ Payment is possible only through VGen;
✦ No refunds policy unless the work on a commission wasn't started at all*;
✦ Full pre-payment before artist start working on client's commission;
✦ You cannot refund after the finish, since it is one of a kind product.
✦ In case of charge back the client loses all rights for the artwork since it would be considered as an unpaid commission.
*Beginning of the work is defined by beginning of the process of the sketch stage.🔎 REVISIONS
✦ On every stage of the illustration process artist is required to send the results. Stages are following:
・ Sketch - creation of the rough sketch, the idea of the future illustration;
・ Lineart - creating polished lines for future colouring;
・ Colour - stage of applying colours;
・ Render - the final stage of polishing illustration.
✦ On the sketch stage you have 3 free of charge adjustments. After sketch is confirmed it is impossible to change it onward;
✦ After finished of the illustration the only possible adjustment is change of colours.🚚 DEADLINES AND DELIVERY
✦ Approximate delivery is one month;
✦ In case of emergencies deadline can be postponed and the client will be informed about it beforehand.🪻 USE
✦ Client may use artwork for PERSONAL USE ONLY unless it was specified during the commission process;
✦ Client may print PERSONAL USE artwork on physical merch (stickers, kaychains, etc) not for sale, unless COMMERCIAL MERCHANDISING rights were bought;
✦ AI training/uploading to datasets/NFT selling/altering of artwork/signature erasure are strictly prohibited;
✦ Created artworks cannot be used for discriminatory, violent and hateful content.
✦ Created artwork cannot be resold.📚 INTELLECTUAL PROPERTY RIGHTS
✦ Credit of the artist (Nynke Stern) as an author is required, and non-negotiable. Claiming of the authorship is strictly prohibited;
✦ Artist reserve the right to use the art piece in portfolio unless it was restricted by NDA;
✦ Commissioner may request MONETIZED CONTENT/COMMERCIAL MERCHANDISING rights, then will be used perpetual license.*NDA is applicable for the term of 1 year unless the terms were negotiated beforehand by the client.
**Perpetual license gives the client the right to use artwork, the authorship remains by artist and it can be revoked in case of violation of agreements.🗨️ COMMUNICATION
✦ Communication is possible ONLY via VGen;
✦ Artist answers only during following time frames (GMT+1):
・ Monday: 10:00 - 18:00;
・ Thursday: 13:00 - 18:00;
・ Friday: 10:00 - 18:00;
・ Saturday: 10:00 - 18:00.
✦ Response can take up to 3 working days.Thank you for considering to commission me!
